What is Civil and Commercial Mediation?

Civil and commercial mediation is a process which individuals and companies can go through, to resolve difficult issues and avoid costly, public legal battles.

A mediator is an impartial third party who works to help people reach agreements, without taking sides, in a confidential process.

Negotiations and discussions that take place in mediation are done so "without prejudice", giving clients a safe place to explore settlement options. Statements and offers made in mediation cannot be disclosed in court.

Mediation gives clients much more control over the outcome, compared to a judge or arbitrator deciding.

Resolving a dispute via mediation tends to be faster than taking a case to court, and cheaper than negotiating via solcitors alone.

Mediation can run alongside the court process, particularly if proceedings have already begun.

Mediation is a highly effective tool that can be used to resolve almost any civil or commercial dispute.

Adept Mediation is committed to providing services to a high professional standard for all our clients. Our mediator Clare Hayes Guymer is a member of the College of Mediators and is registered with the Civil Mediation Council and Family Mediation Council. Clare trained with the Chartered Institute of Arbitrators (CIArb), the London School of Mediation, and National Family Mediation (NFM).

Civil and commercial disputes can often be resolved through mediation within a day, or over shorter sessions across more than one day if needed. The duration of the mediation can vary depending on the complexity of the case and the number of parties involved.

We understand that civil and commercial disputes can be complex in nature. Get in touch with us to discuss the issues you need to resolve and hear about how we may be able to assist.

Pre-Mediation Discussions
The mediator will speak with each party separately on the phone / via video, and will ask for a summary of the case and goals for mediation to be provided by each party (with the summary no longer than two A4 pages, plus any key diagrams).

Parties Sign Agreement to Mediate
Before we can begin mediation, we require all parties to sign the Agreement to Mediate, where the parties and mediator agree to keep mediation discussions confidential.

We take part in the Civil Mediation Council (CMC)'s Fixed Fee Scheme, offering a highly cost-effective mediation option for parties with a total claim of £50,000 or less (see table below).

If the total claim is over £50,000 please get in touch with us to discuss fees and suggested mediation duration for your case.

If the mediation is held in person, any venue hire, travel, refreshments and other associated costs are payable by the parties.

The CMC Fixed Fee Scheme will not be appropriate in all cases, and we reserve the right to decide whether we feel it is appropriate in complex cases.

Please note, we are not associated with the Small Claims Mediation Service (SCMS) and are not a court appointed mediator. If your claim is for less than £10,000, proceedings have already commenced, and a claim form issued (which will come at a cost), you may be able to receive a free 1 hour telephone mediation through the courts.

Mediation
During mediation, the mediator will move between meeting with both parties in joint sessions (as appropriate), to meeting with one party at a time in a caucus (private meeting). The mediator may also practice shuttle mediation, conveying messages and proposals which she has been authorised to disclose to the other party.

If the parties reach resolution on their issues this can be drafted into a legally binding agreement by a solicitor if present, or recorded in a summary by the parties and mediator, and drafted into a legally binding agreement by a solicitor at a later stage if required.

Note: the mediator's role is to facilitate negotiation and resolution of a dispute, not to create legally enforceable documents.
